The calendar and time have failed Mackenzie Shirilla on this one!

The Ohio Supreme Court has thrown out her attempt to get her post-conviction appeals reviewed, noting that her legal team goofed with timing, hence a justified reason to strike out their request.

Mackenzie Shirilla was convicted over a 2022 crash in Ohio, where prosecutors argued she deliberately crashed her car into a building at 100 mph, killing her boyfriend, Dominic Russo, and his friend, Davion Flanagan. She was sentenced to 15 years to life, with parole eligibility after 15 years.

According to the Apex court’s decision today, June 23, Shirilla’s post-conviction appeal filing came in rather too late as it was submitted after the legal deadline, in which the lower court had no authority to ignore such a large-scale delay.

According to court filings, Shirilla’s legal team approached the court for a review after they discovered a calendar-related error. Court documents proved that Shirilla’s attorney had missed the deadline to file a post-conviction challenge by one day, due to their failure to factor in the 2024 leap year when calculating the filing date.
