The Ohio Supreme Court has thrown out her attempt to get her post-conviction appeals reviewed, noting that her legal team goofed with timing, hence a justified reason to strike out their request.
Mackenzie Shirilla was convicted over a 2022 crash in Ohio, where prosecutors argued she deliberately crashed her car into a building at 100 mph, killing her boyfriend, Dominic Russo, and his friend, Davion Flanagan. She was sentenced to 15 years to life, with parole eligibility after 15 years.
According to the Apex court’s decision today, June 23, Shirilla’s post-conviction appeal filing came in rather too late as it was submitted after the legal deadline, in which the lower court had no authority to ignore such a large-scale delay.
According to court filings, Shirilla’s legal team approached the court for a review after they discovered a calendar-related error. Court documents proved that Shirilla’s attorney had missed the deadline to file a post-conviction challenge by one day, due to their failure to factor in the 2024 leap year when calculating the filing date.
On Tuesday, the Ohio Supreme Court upheld the initial judgment by the lower court, which concluded that the trial court did not have legal authority to consider the late petition. As established under the legal provisions in Ohio, defendants usually have a 365-day window from the filing of trial transcripts to challenge their conviction.
Prosecutors had insisted that Shirilla’s deadline began on October 23, 2023, making her October 24, 2024, filing untimely. In April 2026, her new legal team appealed to the state’s Supreme Court, stating that the filing period should have begun later, as a transcript was submitted after the initial trial transcript.
They also stated that she might not have been found guilty if she had been provided constitutionally sufficient legal representation. In its decision, the Supreme Court highlighted the procedure and found that the arguments did not meet any of the legal exceptions that would permit the late filing to proceed.
Cleveland 19 noted that Justice R. Patrick DeWine issued a dissent as Shirilla’s initial parole hearing is still set for 2037.
The 21-Year-Old’s Alleged Unruly Conduct Behind Bars Made The News In May, The Blast noted that sources revealed that Shirilla’s worrisome behavior in jail may poke holes in her team’s campaign to secure an early release.
Although the 21-year-old who is currently serving two concurrent sentences of 15 years to life is still years away from any parole eligibility, there are still questions about the role her current behavior would play in future considerations.
Shirilla has accumulated multiple disciplinary violations during her incarceration, including incidents reportedly classified as sexual misconduct. She had reportedly indulged in a number of violations regarding alterations to prison-issued clothing and possession of banned items.
In one of the incidents listed in the records, prison officials allegedly discovered prescription drugs that were not prescribed to Shirilla in January 2025. Officials also referenced a personal photograph they alleged depicted drug-related activity.
Shirilla, however, denied these claims in conversations with prison officials, claiming that she was not taking drugs in the picture while insisting the pills found on her were prenatal vitamins she had received from another prisoner.
The disciplinary reports for the crime may or may not be factored into parole consideration, but institutional behavior is one of the things that is considered during parole hearing reviews.
Mackenzie Shirilla’s Explicit Behavior Identified As Another Stumbling Block In addition to the reported possession of contraband, prison records reveal that Shirilla experienced other disciplinary problems. According to officials, Shirilla was also found in possession of several explicit magazine images, although reports indicate she did not clearly admit to or deny possessing them.
Authorities also claimed that the 21-year-old engaged in an inappropriate video call with a visitor, which was in breach of prison conduct policies. According to records, Shirilla exposed herself during the encounter, and the visitor was also seen performing explicit acts in front of the camera.
Other reports of a possible violation were reported in August 2025, when a corrections officer allegedly saw Shirilla engaging in consensual contact with another inmate that the authorities deemed to be prohibited by prison rules. Shirilla has admitted that she was not involved in any improper relationship with the inmate.
There is also a record of an occasion where Shirilla allegedly made comments regarding a prison employee’s reaction to her outfit. When asked about concerns, she said that she would not be held accountable for the reaction of the staff member and that she would leave it to the discretion of that individual.
After her comment, officers reportedly took her to a restroom area to ensure she was appropriately dressed to the standards of the institution.
Gypsy Rose Blanchard Predicted A Tough Road For The 21-Year-Old

Blanchard, who was convicted of second-degree murder in connection with her mother’s death in 2016 and later served time in prison, shared her perspective on Shirilla’s incarceration.
The Blast noted that the interview happened after she watched the Netflix documentary “The Crash,” which revisits Shirilla’s conviction and sentencing.
Before discussing the case, Blanchard declared that she would not describe herself as someone deeply invested in true crime, although she occasionally watches crime-related documentaries.
She was then asked whether she believed there was any chance the Supreme Court would overturn Shirilla’s conviction, to which she said she did not see that happening.
Explaining her position, Blanchard suggested the documentary did not appear to strengthen Shirilla’s case, particularly in light of reports she had heard regarding Shirilla’s conduct while incarcerated.
Although Shirilla may become eligible to appear before a parole board after serving 15 years of her sentence, Blanchard also expressed doubt that early release would be likely.
Drawing from her own understanding of the prison system, Blanchard explained that parole decisions often place significant weight on whether inmates demonstrate remorse and how they conduct themselves while serving their sentence.
Mackenzie Shirilla’s Mother Challenges Online Narratives About Daughter’s Case With public interest in Shirilla’s case growing even louder, her mother, Natalie Shirilla, debuted the way her daughter has been represented and provided what she feels is the other side of the story.
In an interview after the renewed attention due to Netflix’s “The Crash,” Natalie spoke about the allegations her family has been subjected to since the 2022 crash, which killed Shirilla’s boyfriend and their friend.
Natalie admitted that many may never be able to detach her from the tragedy, but she has learned to take public criticism while rejecting the notion that she or her daughter should be labeled the villain.
She continued that she understood how people see her family through the prism of loss, but that those closest to Shirilla have a different version of her, one that is deeply affected by what occurred and continues to carry the emotional burden.
Natalie also challenged the long-running online rumors concerning her daughter’s romance with Russo. She disputed speculation that he had planned to end the relationship or that there had been previous incidents suggesting intentional harm.
Speaking emotionally about Russo, Natalie said he remained someone she cared about deeply and described his loss as something her family continues to mourn. She also spoke about the things that Russo allegedly struggled with privately, such as mental health issues and emotional issues.
Natalie noted that while Shirilla and Russo did not always have good chemistry and often argued, she still thinks many aspects of their dynamic have been misinterpreted in the public discussion of the case.
