Scott Peterson’s latest attempt to overturn his conviction in the murders of his pregnant wife, Laci, and their unborn son, Conner, has been denied.

The Stanislaus County District Attorney’s Office said that San Mateo County Superior Court judge Elizabeth M. Hill’s April 27 ruling showed “once again, the process worked.”

“Judge Hill recognized the most recent attempt to undo the jury’s verdict for what it was — nothing more than recycled, repackaged and rebranded arguments,” Stanislaus County District Attorney Jeff Laugero announced on Tuesday, May 12. “Laci, Conner and their family deserve the finality that justice promised them.”

Hill denied Peterson’s third petition for a writ of habeas corpus in its entirety, denying all 14 claims in a 116-page order, prosecutors said.

According to the district attorney’s office, Peterson, who is serving a life sentence without the possibility of parole, filed the petition in August 2025, which included a claim of “actual innocence, recycling arguments that courts have rejected at every level since his conviction in 2004.”

Peterson, 53, was arrested in April 2003 after Laci, 27, and Conner’s badly decomposed bodies were found in the San Francisco Bay. Conner was found in the bay on April 13, 2003, by a couple walking their dog. A day later, the body of Laci washed onto the shore one mile away from where the baby’s body was found.

Peterson was convicted on two counts of first-degree murder and sentenced to death in 2005. However, his death sentence was overturned in 2020.

According to prosecutors, since Peterson’s conviction he has filed a motion for a new trial, a direct appeal, three petitions for a writ of habeas corpus, four requests for post-conviction DNA testing and three motions for post-conviction discovery.

“Each attempt has failed,” prosecutors said in the release.

In 2024, the Los Angeles Innocence Project took up Peterson’s efforts to be released, claiming that new evidence proved his innocence and his state and federal constitutional rights were violated.

Much of the new evidence the attorneys claimed centered around a December 2002 burglary of a Modesto home across the street from the house where Scott and Laci lived and that her death was related to the burglary.

In denying the order, Hill wrote the defense evidence wasn’t new, but “merely repeats and elaborates upon the same contested theories that existed at the time of trial,” the Los Angeles Times reported.

The Los Angeles Innocence Project plans to appeal Hill’s ruling.

“We disagree with and are disappointed by the court’s ruling on every level.  The ruling demonstrates a profound misunderstanding and misapplication of the law applied to habeas corpus petitions,” said Hannah Brown, LAIP’s Deputy Director.

According to prosecutors, Peterson’s appeal of a 2025 ruling on his second habeas petition concerning a juror bias claim is still pending.
